Notice and Removal of Non-Consensual Intimate Visual Depictions
About this policy: This policy is provided by A+ Hosting Inc., a Nevada corporation, and applies to all services purchased through any of our three brand websites: APlusHosting.com, ServerPoint.com, and ColossusCloud.com. The terms below apply identically regardless of which brand website you signed up through. References to "we", "us", or "our" in this document mean A+ Hosting Inc.
Non-consensual intimate visual imagery of an identifiable individual online is prohibited under the U.S. federal "TAKE IT DOWN Act." If you wish to report images that are intimate depictions published without your consent and A+ Hosting Inc. is the hosting provider, please submit a notice through our Contact Us page. Each notice must include all of the following:
- Location of the material. Identification of the intimate visual depiction published without consent, with information reasonably sufficient to permit us to locate it. This must include a specific URL for each instance of publication.
- Good faith statement. A statement that the identifiable individual has a good-faith belief that the intimate visual depiction(s) identified in the notice is not consensual.
- Statement under penalty of perjury. Where the notice is not submitted by the identifiable individual, a statement that the information in the notification is accurate, and, under penalty of perjury, that the reporter is authorized to act on behalf of the identifiable individual.
- Contact information. Information reasonably sufficient to permit us to contact the identifiable individual (or an authorized person acting on their behalf).
- Signature. A physical or electronic signature of the identifiable individual or authorized person acting on their behalf.
1. Upon receipt of a notice
We will review the submission for completeness and confirm that the website uses our hosting services. If we are not the hosting provider, we will inform you so that the notice can be submitted to the proper provider. If we do provide hosting services, we will promptly locate the material identified in the notice and remove or disable access to it.
2. Registrar-only matters
If A+ Hosting Inc. acts only as the domain registrar and does not provide hosting services for the disputed content, we do not have the technical ability to act on this notice. The notice should be directed to the hosting provider.
3. Modifications
A+ Hosting Inc. reserves the right to modify this policy at any time in its sole and absolute discretion. Modifications take effect immediately upon posting to this website.
