California Privacy Rights (CCPA/CPRA)

This California Privacy Rights Notice supplements our Privacy Policy and applies solely to California residents. It describes how A+ Hosting Inc. DBA ServerPoint.com ("ServerPoint", "we", "us", "our") collects, uses, discloses, and protects personal information in accordance with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA).

1. Your Rights Under California Law

In Plain English: As a California resident, you can: see what data we have about you, ask us to delete it, correct mistakes, opt out of data sales (though we don't sell data), and limit use of sensitive info. We won't treat you differently for exercising these rights.

As a California resident, you have the following rights regarding your personal information:

Right to Know (Access)

You have the right to request that we disclose the following information about our collection and use of your personal information over the past 12 months:

  • The categories of personal information we collected about you
  • The categories of sources from which we collected personal information
  • Our business or commercial purpose for collecting or selling personal information
  • The categories of third parties with whom we share personal information
  • The specific pieces of personal information we collected about you

Right to Delete

You have the right to request that we delete any personal information we collected from you, subject to certain exceptions. Once we receive and verify your request, we will delete your personal information unless an exception applies, such as:

  • Completing the transaction for which the information was collected
  • Detecting security incidents or protecting against fraud
  • Debugging to identify and repair errors
  • Complying with legal obligations
  • Internal uses reasonably aligned with your expectations

Right to Correct

You have the right to request that we correct inaccurate personal information we maintain about you, taking into account the nature of the personal information and the purposes for processing.

Right to Opt-Out of Sale or Sharing

You have the right to opt out of the "sale" or "sharing" of your personal information. ServerPoint does not sell personal information in the traditional sense, and we do not share personal information for cross-context behavioral advertising.

If we collect sensitive personal information (such as Social Security numbers, financial account information, or precise geolocation), you have the right to limit our use of such information to what is necessary to provide the services you requested.

Right to Non-Discrimination

We will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not:

  • Charge you different prices or rates
  • Provide you a different level or quality of goods or services
  • Suggest that you may receive different prices, rates, or quality

In Plain English: We collect identifiers (name, email, etc.), payment info, internet activity (IP, browser), and commercial info (what you bought). We get this directly from you or automatically when you use our services.

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. The criteria used to determine retention periods include:

7. How to Exercise Your Rights

To exercise your California privacy rights, you may submit a request by:

You may also designate an authorized agent to make a request on your behalf. To do so, you must provide the agent with written permission and we may require you to verify your identity directly with us.

Verification Process

When you submit a request, we will take reasonable steps to verify your identity before responding. This typically involves:

  • Matching information you provide with information we have on file
  • Asking you to confirm information associated with your account
  • For requests for specific pieces of personal information, requiring a signed declaration under penalty of perjury

Response Timing

We will respond to verifiable consumer requests within 45 days of receipt. If we require more time, we will inform you of the reason and extension period in writing. We may take up to an additional 45 days if reasonably necessary.

8. Financial Incentives

We do not offer financial incentives or price differences in exchange for the retention or sale of personal information.

9. Minors Under 16

We do not knowingly collect personal information from minors under 16 years of age. We do not sell or share personal information of consumers we know to be under 16.

10. Do Not Track

California law requires us to disclose how we respond to web browser Do Not Track signals. We currently do not respond to Do Not Track signals because a uniform standard has not been adopted. For more information about Do Not Track, visit allaboutdnt.com.

11. California "Shine the Light" Law

California Civil Code Section 1798.83 permits California residents to request information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their direct marketing purposes.
