Domain UDRP Information
What is UDRP?
The Uniform Domain-Name Dispute-Resolution Policy (UDRP) is a process established by ICANN for resolving disputes regarding the registration of internet domain names. It provides a mechanism for trademark holders to challenge domain registrations they believe infringe on their rights.
When Does UDRP Apply?
UDRP proceedings may be initiated when a complainant alleges that:
- A domain name is identical or confusingly similar to their trademark
- The registrant has no legitimate rights or interests in the domain
- The domain was registered and is being used in bad faith
ServerPoint's Role in UDRP
As an ICANN-accredited registrar (IANA ID: 4325), ServerPoint:
- Responds to UDRP provider requests within two business days
- Implements a registrar lock on disputed domains
- Enforces UDRP panel decisions within ten business days
- Maintains domain status during proceedings
What Happens During a UDRP Proceeding?
- Complaint Filed: A trademark holder files a complaint with a UDRP provider
- Lock Applied: ServerPoint locks the domain to prevent transfers
- Response Period: The registrant has 20 days to respond
- Panel Decision: A panel reviews the case and issues a decision
- Implementation: If transfer/cancellation is ordered, it is implemented after 10 business days (unless court action is filed)
Your Rights as a Registrant
If you receive a UDRP complaint:
- You will be notified by the UDRP provider
- You have 20 days to submit a response
- If you lose, you have 10 business days to file court action to prevent transfer
