Texas Privacy Rights (TDPSA)

This Texas Privacy Rights Notice supplements our Privacy Policy and applies to Texas residents. It describes how A+ Hosting Inc. DBA ServerPoint.com ("ServerPoint", "we", "us", "our") collects, uses, and protects personal data in accordance with the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024.

1. Applicability

The TDPSA applies to entities that conduct business in Texas or produce products or services consumed by Texas residents and that process or sell personal data. This notice provides Texas residents with information about their privacy rights under the TDPSA.

2. Your Rights Under Texas Law

In Plain English: As a Texas resident, you can: confirm if we have your data, access it, correct mistakes, delete it, get a portable copy, and opt out of data sales and targeted advertising. We won't discriminate against you for using these rights.

As a Texas resident, you have the following rights regarding your personal data:

Right to Confirm and Access

You have the right to confirm whether we are processing your personal data and to access that personal data.

Right to Correct

You have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing.

Right to Delete

You have the right to delete personal data you have provided to us or that we have obtained about you, subject to certain exceptions.

Right to Data Portability

You have the right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance.

Right to Opt Out

You have the right to opt out of:

  • The sale of your personal data
  • Targeted advertising
  • Profiling in furtherance of decisions that produce legal or similarly significant effects concerning you

Right to Non-Discrimination

You have the right not to be discriminated against for exercising your privacy rights. We will not deny goods or services, charge different prices, or provide different quality of goods or services because you exercised your rights.

3. Our Data Practices

In Plain English: We collect your name, contact info, payment details, and technical data (like IP address). We don't sell your data, don't do targeted advertising, and don't make automated decisions about you.

Personal Data We Collect

We may collect the following categories of personal data:

  • Identifiers: Name, email address, postal address, phone number, IP address, account credentials
  • Commercial Information: Purchase history, services obtained, payment information
  • Internet/Network Activity: Browsing history on our website, search queries, interaction with our services
  • Geolocation Data: Approximate location based on IP address
  • Professional Information: Company name, job title (if provided)

Sensitive Personal Data

Under the TDPSA, sensitive personal data includes certain categories that require additional protections. We may collect the following sensitive personal data:

  • Account Login Credentials: Username and password combinations (passwords are stored in encrypted form)
  • Financial Data: Payment card information (processed by secure third-party payment processors)

We process sensitive personal data only to provide the services you have requested and do not use it for purposes beyond what is reasonably necessary.

How We Use Personal Data

We use personal data for the following purposes:

  • Providing and maintaining our hosting and related services
  • Processing transactions and billing
  • Communicating with you about your account and services
  • Providing customer support

Sale of Personal Data

We do not currently engage in targeted advertising as defined by the TDPSA. We do not use personal data obtained from your activities across different websites or online applications to display advertisements selected based on predicted preferences.

Profiling

We do not engage in profiling that produces legal or similarly significant effects concerning Texas residents.

4. Third-Party Sharing

We may share personal data with the following categories of third parties for legitimate business purposes:

  • Service Providers: Companies that help us provide our services, such as payment processors, data centers, and customer support platforms
  • Business Partners: Domain registrars and other partners necessary to provide requested services
  • Legal and Regulatory: Government agencies, courts, and law enforcement when required by law or to protect our rights

5. How to Exercise Your Rights

To exercise your Texas privacy rights, you may submit a request by:

Verification

We will take reasonable steps to verify your identity before responding to your request. This may include asking you to confirm information we have on file about you or provide additional information to verify your identity.

Authorized Agent

You may designate an authorized agent to make a request on your behalf. We may require the authorized agent to demonstrate that they have been authorized to act on your behalf.

Response Timing

We will respond to your request within 45 days of receipt. If we need additional time, we will inform you of the reason and may extend the response period by up to an additional 45 days.

Appeals

If we decline to take action on your request, you may appeal our decision by contacting us at [email protected] with the subject line "TDPSA Appeal." We will respond to your appeal within 60 days.

6. Data Security

We maintain reasonable administrative, technical, and physical safeguards to protect personal data from unauthorized access, use, modification, and disclosure. These measures include:

  • Encryption of data in transit and at rest
  • Access controls and authentication requirements
  • Regular security assessments
  • Employee training on data protection

7. Children's Privacy

Our services are not directed to individuals under 18 years of age. We do not knowingly collect personal data from children. If we learn that we have collected personal data from a child, we will take steps to delete that information.

8. Universal Opt-Out Mechanisms

The TDPSA requires businesses to honor universal opt-out mechanisms (such as Global Privacy Control signals) beginning January 1, 2025. We will honor such signals as required by law.
